| DUI & DWAI Matters: | | What Is The Difference Between A DUI & A DWAI? A DUI (Driving under the Influence of Alcohol or Drugs) is a more serious offense. A person could be charged with a DUI if their Blood Alcohol Content (BAC) was .08% or above.
A DWAI (Driving While Ability Impaired) is a less serious offense. A person could be charged with a DWAI if their BAC was .05%, but less than .08%.
What Are The Consequences? Will My License Be Suspended? There are criminal and administrative penalties for drunk driving. There are several potential consequences for committing a DUI/DWAI, including license suspensions, points on your driving record, jail time, fines, and public service requirements. Penalties depend on whether you have committed multiple DUI or DWAI offenses in the past and your blood alcohol content.
If you have committed your 1st DUI, the potential consequences include:- License Suspension of 9 months
- 12 points on your driving record
- 5 days – 1 year in jail
- $600 – 1000 fine
- Public Service 48-96 hours.
If you have committed your 1st DWAI, the potential consequences include:- 8 points on your driving record
- 48 hours to 180 days in jail
- $200 – 500 fine
- Public service 24-48 hours
If you have committed more than one DUI/DWAI, your consequences will likely be more severe.
How is impairment tested in Colorado? Roadside sobriety tests could range from standing on one leg, walking in a straight line, or submitting to a blood or breathe test. The law enforcement officer may ask you to take a blood, breath, saliva, or urine test to determine your BAC level.
Are there any defenses to DUI & DWAI? There are defenses to a charge of DUI/DWAI, however our attorneys must investigate the facts of each case in order to determine which are applicable.
