Municipal Code Enforcement

What Are Some Examples Of Municipal Code Violations?

Municipal codes vary on the needs of the city and town. Municipal code generally involves enforcement in the following areas:
  • Unsanitary living conditions
  • Unsteady and hazardous structures
  • Illegal zoning
  • Fire, health, safety code violations
  • Parking
What Is The Penalty For Municipal Code Violation?

Municipal code violations will vary from city to city or town to town. The penalty for the violation may also depend on the severity of the violation. Depending on the violation and the municipality, you could be subject to a hefty fine, a lien on your property, or much worse.

What Procedures Must The Police And Investigators Follow?

Because municipal codes vary from city to city, there is not necessarily a uniform procedure police or code enforcement officers use. However, there are similar steps that municipal code enforcers use in order to provide the suspected violator to correct the violation. In general, the violation must first be investigated or confirmed by a person authorized to enforce the municipal code. Then, a Notice of the Violation would be sent or posted on the property to provide the resident or legal property owner with notice and time to correct the violation. If the violation has not been corrected after a specified time, then the municipality may pursue further enforcement action such as enforcing a fee or lien on the property. Our criminal defense attorneys can assist you in determining the procedures that the code enforcement officers must follow.

Are There Any Defenses To Municipal Code Violations?

There could be different defenses to a municipal code violation. For example, the municipality may not have enforced the violation properly. Additionally, the municipal code may be outdated or arbitrary, which could be used in your defense. Our criminal defense attorneys can assist you in determining your defenses and options.
