A court appointed position to take care of another's medical, housing, educational or financial needs. Our attorneys will help you determine whether a guardianship or conservatorship is necessary and whether the proposed guardian will qualify. Finding the right guardian or conservator is vitally important in the probate process. One's guardians will be able to take certain actions on your behalf, like selling your real estate and making important medical and financial decisions.
A conservator may be needed if a minor child inherits money in excess of a certain amount to manage the money for the benefit of the minor child. A conservator has a legal duty to use and protect the financial interests of the minor child until the child reaches the age of twenty-one (21). Additionally, if a child is listed as a beneficiary of a life insurance policy, the life insurance company will require that a conservator be appointed before payment is made. Any real property that is to be given to the child must be sold by the conservator and proceeds retained for the minor child in the conservatorship.
Whether necessary to start the process to qualify for government benefits, or as part of a personal injury settlement or for other needs, our attorneys can assist you in creating guardianship or conservatorships to meet your loved one's needs. Our firm can assist in preparing paperwork to get the appointment as well as annual reviews required by law. |
